These terms apply to every order you place with Silly Market and to your use of this site. The site and the shop are operated by Electronic Frog LLC, 30 N GOULD ST STE N, Sheridan, Wyoming, 82801, United States (“we”, “us”). By placing an order you agree to these terms, the Shipping Policy and the Refund Policy. Our Privacy Policy explains how we handle your personal data. Read them before you order; the checkout page links to them next to the order button.
Which version applies
The version of these terms shown on this page, with its Last updated date, applies to orders placed on or after that date. Earlier versions are kept, and the version that was in force when you ordered is the one that governs that order. If we change these terms we update the date at the top; a change never applies to an order you already placed.
Who can order
You must be at least 18 years old, or the age of majority where you live, to place an order. The shop sells to consumers for personal use. If you want to order for a business, or in quantity, contact us first.
Products and prices
Every item is printed after you order it. Colors on a screen differ from printed colors, and print placement can vary by a small amount from one item to the next. These differences are not defects. A misprint, a damaged print, or the wrong item is a defect, and the Refund Policy covers it.
Prices are in US dollars. The price you pay is the price shown at checkout when you place the order, plus shipping and any sales tax that applies to your address, all of which are shown before you confirm the order. Prices on the site can change; a change does not affect an order you already placed.
If we find a clear pricing error on an order, for example a product listed at $2 instead of $20, we contact you before we print. You can then keep the order at the correct price or cancel it for a full refund.
Orders
An order is placed when you confirm it at checkout and payment is authorized. We send an order confirmation by email. We can refuse or cancel an order if we suspect fraud, if the payment fails, or if the order breaks these terms; if we cancel an order you already paid for, we refund it in full within 7 business days.
You can change or cancel an order until it goes to print, usually within one business day of ordering. After that the item exists and cannot be changed or canceled. See the Refund Policy.
Payment
Payment is taken when you place the order, through the payment methods shown at checkout. Card details are entered on a form served by our payment provider and are not stored by us.
Shipping and risk of loss
Delivery times and methods are in the Shipping Policy. Risk of loss passes to you when the package is delivered to the address you gave. If the carrier loses the package before delivery, the Refund Policy applies and we replace the order.
Taxes
Sales tax is calculated at checkout for the address you give, where the law requires us to collect it. You pay it with the order; there are no further charges after delivery for orders within the United States.
Limited warranty
We warrant that each item is free from printing and production defects for 30 days from the delivery date. If an item has such a defect in that period, we replace it or refund it as described in the Refund Policy. This is the full remedy under the warranty. Any implied warranty is limited to the same 30 days. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you; this warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
The warranty does not cover normal wear, damage caused after delivery, or a print that faded because the care instructions were not followed. It does not cover fit or a change of mind.
Limitation of liability
Our total liability for an order is limited to the amount you paid for that order. We are not liable for indirect losses such as lost profit or missed events. This limit does not apply to anything the law does not allow us to limit, including death or personal injury caused by our negligence, and it does not reduce the rights the warranty above gives you.
Reviews and photos you send us
You keep the copyright in a review or photo you submit. By submitting it you allow us to show it on the site, in our email and in our marketing, with the name you chose. You can withdraw that permission at any time by emailing support@sillymarket.com, and we remove the item from the site and from future marketing within 10 business days. Nothing in these terms stops you from writing an honest review of us, here or anywhere else.
We remove a review that is off-topic, abusive, or that we have reason to think is not from a customer.
Our designs and content
The designs, names, text and images on this site belong to us or to the people who license them to us. Buying a shirt does not give you the right to reproduce the design on it or use it on anything else. You may share links to the site and images of products you bought.
If you believe material on this site infringes your copyright, email support@sillymarket.com with your name and contact details, which work you own, which page it appears on, a statement that you believe in good faith the use is unauthorized, and a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act for the owner. We remove the material while we look into it.
Affiliate program
If we run an affiliate program, it has its own terms, which you accept when you apply. Commissions on an order that is canceled, refunded or charged back are reversed.
Acceptable use
Do not use the site to break the law, to try to get into systems or accounts that are not yours, to scrape the catalog with automated tools, or to place orders you do not intend to pay for. We can refuse service to anyone who does.
Disputes
We want to hear about a problem before it becomes a dispute: email support@sillymarket.com and we answer as soon as we can. Most problems with an order are solved under the Refund Policy without anything further.
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, and by applicable federal law. A dispute that we cannot solve between us is brought in the state or federal courts of the State of Wyoming, or in small claims court. Where the law of the state where you live gives you the right to bring a claim there, that right is not affected.
General
If a court or arbitrator finds part of these terms unenforceable, the rest still applies. If we do not enforce a term once, we can still enforce it later. You cannot transfer your rights under these terms to someone else; we can transfer ours to a company that takes over the shop, and we tell you when that happens. These terms, with the Shipping Policy and the Refund Policy, are the whole agreement between you and us for an order.
